Preamble

These Terms of Use and Sale ("Terms") govern the use of the MyRezto service, published by PariSéville (SASU). Any subscription to the service implies full and complete acceptance of these Terms.

Definitions

  • Publisher : PariSéville, the company publishing the MyRezto service.
  • Service : All features offered on myrezto.com and accessible by subscription (digital menu creation, QR code, multilingual translation, blog, statistics).
  • Customer : Any individual or legal entity that has subscribed to a paid subscription to the service.
  • Visitor : Any user of a Customer's public site (e.g. a diner scanning the QR code at a table).

Service description

MyRezto is a B2B SaaS software intended for restaurateurs. The service includes:

  • Creation and publication of a multilingual digital menu editable from a back office.
  • Generation of a QR code allowing customers to access the menu from their smartphone.
  • Automatic translation of dishes and categories into French, English and Spanish via AI (Anthropic Claude).
  • Integrated blog, ability to publish articles.
  • Attendance statistics (number of views, most viewed dishes).

Pricing

Two subscription plans are offered:

  • Monthly: €14.90 + VAT / month.
  • Yearly: €149 + VAT / year (equivalent to €12.42 + VAT / month).

Prices are shown excluding tax. Applicable VAT is added at payment time according to the Customer's tax status (French VAT for FR customers, reverse charge for EU pros with VAT number, local VAT via OSS for EU consumers).

The Publisher reserves the right to modify prices at any time. New prices apply only to new subscriptions; ongoing subscriptions continue at the original rate until the next renewal.

Free trial period

Any new subscription benefits from a 30-day free trial period from the date of registration. During this period, no charge is made on the credit card, which is nevertheless registered with Stripe to allow automatic billing at the end of the trial. The Customer can cancel their subscription at any time during the trial at no cost.

Payment terms

Payment is made by credit card via our provider Stripe, certified PCI DSS Level 1. Card data (number, CVV, expiry date) never transits through the Publisher's servers.

The subscription is automatically renewed at the end of each period (monthly or yearly) unless previously cancelled by the Customer. The amount is charged to the registered card on the renewal day.

In case of payment failure, Stripe performs several retry attempts over a period of 7 to 21 days. If all fail, the subscription is automatically cancelled and the Customer's public site is deactivated.

Right of withdrawal

In accordance with article L221-3 of the French Consumer Code, the 14-day right of withdrawal does not apply to contracts concluded between professionals (B2B). Nevertheless, the 30-day free trial allows the Customer to test the service without commitment before any payment.

Cancellation

The Customer can cancel their subscription at any time from their management area ("Manage my subscription", accessible from the back office). Two options are offered by Stripe: immediate cancellation (the service stops immediately, no prorated refund) or cancellation at the end of the period (the service remains accessible until the end of the already-paid period, then is not renewed).

Account suspension

The Publisher reserves the right to suspend or terminate an account in case of breach of these Terms, abusive use of the service, or proven payment default. A prior notice will be sent by email, except in case of emergency (security breach, legal violation).

Obligations of the parties

The Publisher undertakes to provide a quality service, in accordance with the description, with reasonable availability. Occasional interruptions for maintenance may occur and will be announced as far as possible.

The Customer undertakes to provide accurate information at registration, to maintain the confidentiality of their credentials, not to publish illegal content (hateful, defamatory, counterfeit, etc.) and to respect the rights of third parties.

Personal data

The processing of personal data is subject to a dedicated privacy policy, accessible from the site.

For visitor data collected by the Customer via the service (e.g. blog comments), the Publisher acts as a sub-processor within the meaning of the GDPR. A data processing agreement (DPA) can be signed on request to the contact address.

Intellectual property

The service, its features, code, design and brand remain the exclusive property of the Publisher. The Customer retains full ownership of the content they publish (texts, images, recipes, etc.) and grants the Publisher a licence strictly limited to the provision of the service.

Liability

The Publisher provides the service as is and cannot be held liable for indirect damages (loss of business, lost profits, damage to image, etc.). In any event, the Publisher's total liability is limited to the amount actually paid by the Customer for the subscription over the last 12 months.

Force majeure

Neither party will be held liable for a breach of these Terms resulting from a force majeure event as defined by French case law (natural disaster, major power outage, massive cyberattack, etc.).

Modification of the Terms

The Publisher reserves the right to modify these Terms at any time. Substantial changes will be notified by email to active Customers at least 30 days before they come into force. The Customer may cancel their subscription at no cost if they do not accept the new conditions.

Governing law and jurisdiction

These Terms are subject to French law. Any dispute relating to their execution or interpretation will, failing amicable resolution, be subject to the exclusive jurisdiction of the French courts of the Publisher's registered office.
